This agreement/information notice requires you to comply with the Diving Center regulations and also contains additional general and specific obligations and information.

This agreement/information notice shall remain valid until 31-12-2026

1. Organization and management of activities 

A) When you participate in activities organized by PROFONDO E BLU D.C. (hereinafter also referred to as the “Diving Center”), such activities are carried out with the assistance and under the supervision of a professional/guide from the Diving Center staff.
B) When you participate in water activities organized by third parties making use of the Diving Center’s support, such activities are carried out independently, without any supervision/control/organization in the water by the professionals of the PROFONDO E BLU D.C. staff. The Diving Center only organizes and manages boat activities, water entry and exit procedures, and onshore support.

2. Termination

The undersigned declares to have read the Diving Center regulations and to have understood all individual provisions therein, and undertakes to comply with them in the full awareness that failure to comply with the provisions contained therein shall result in the termination of the contract for participation in the guided dive entered into with the Diving Center. The undersigned also declares to be aware that any violation of the instructions received from the Captain of the vessel/boat and/or from the dive guide before and during the excursion constitutes grounds for termination of the contract.

3. Exclusion

The undersigned declares to be aware that failure to comply with the rules set out in the regulations and with the instructions received from the guide during the briefing, in addition to resulting in termination of the contract, may also constitute grounds for exclusion from all activities, both current and future, carried out by the Diving Center in the course of its business.

4. Use of Diving Center facilities and boats

The undersigned declares to have understood all necessary information and the conduct required to properly use the services offered and the facilities/areas (common areas, changing rooms, bathrooms, access passage to the boat) of the Diving Center, as well as its boats.

• 4.1 Personal belongings
  All personal belongings and clothing may be stored in the designated areas indicated by the PROFONDO E BLU staff. For the safekeeping of goods with a total value exceeding € 100.00, the user is required to contact the management, which will arrange for their custody.

5. Briefing

The undersigned undertakes to attend carefully, before each activity, the informational briefing held by the Diving Center staff, fully aware that the information received during the briefing concerns: safety; the routes to be followed; proper conduct before the dive, during sea activities, and during exit from the water and return to the boat; signals used during guided snorkeling; and the rules necessary for a safe ascent.

6. Information Notice

The undersigned receives the following information from the Diving Center: “Guided snorkeling activities will take place following the routes described during the briefing. Participants who request it will be accompanied for the entire duration of the excursion by a qualified dive guide (or instructor) provided by the Diving Center. 

7. Personal and medical information

The undersigned acknowledges that the information listed below from letters “A” to “L” constitutes an exchange of information between the parties and therefore declares to be aware of the need to read and understand it carefully. The participant also declares to have been informed by the Diving Center that: “should any of the psychological or physical conditions, infections, pathologies, illnesses, surgeries, situations and/or states described and indicated in letters A to L occur, snorkeling activity is dangerous to health and, in the most serious cases, even fatal.  False, misleading or inaccurate information, as well as omission of the requested information regarding one’s medical history and psychological-physical condition, may expose the participant to serious health risks”. 

I DECLARE AND FORMALLY UNDERTAKE

A) to possess a valid medical certificate of good health;

B) to be in suitable psychological and physical condition to carry out snorkeling activities;

C) not to have taken and not to take narcotic and/or psychotropic substances, not to be under the influence of medication, and not to have excessively consumed alcoholic beverages or food;

D) to be aware of the foreseeable and unforeseeable risks connected with snorkeling activities and to knowingly assume such risks;

E) to know and comply, before, during and after the excursion, with all rules, safety provisions and limitations connected with and related to snorkeling activities, also considering my experience and level of training;

F) to observe and comply with national laws, provisions and safety procedures issued by the vessel staff;

G) I am aware that snorkeling activities may also take place in locations far from centers equipped with competent medical assistance and I accept to participate under my full responsibility;

H) not to engage in any type of fishing during snorkeling activities and not to remove objects or marine organisms;

I) to assume from now on any responsibility concerning my person for personal injury and/or damage caused to others due to conduct not compliant with good snorkeling practices or objectively irresponsible behavior;

L) to have carefully read and evaluated the dive center regulations as well as the content of this document and to have clearly understood the meaning of each individual point before signing it.

For the purposes of Articles 1341 and 1342 of the Italian Civil Code, I understand, share and expressly accept all the points and purposes of these rules established for my safety and that of all participants in the dive.

8. Directives and obligations

The undersigned undertakes to strictly comply with the Diving Center regulations and all indications, instructions and directives received from the guide during the activity.
The undersigned also undertakes to follow the route without leaving the group and while maintaining the buddy system.
The undersigned acknowledges the guide’s right to modify or interrupt the dive at any time for safety reasons, in the event of improper conduct or situations that may endanger participants.
The undersigned hereby waives any request for reimbursement of the price paid.

9. Mandatory communications

The undersigned undertakes to promptly communicate to the guide any situation of discomfort, before, during and after the excursion (anxiety, excessive stress, cold, fatigue).

10. Equipment

Rental equipment must be handled with care and returned in the same condition in which it was received. Personal equipment must be perfectly functional and suitable for its intended use. The diver is required to ensure the perfect functioning of their own equipment. The diver declares to know how to use it personally and without causing harm to others.

PRIVACY NOTICE
(mandatory for the provision of services)

The undersigned authorizes the Diving Center to process personal data, including data considered special categories of data, for purposes related to membership/registration/booking of the services provided by the Diving Center, as well as for administrative and accounting purposes. To this end, the undersigned declares to have read the Diving Center regulations and the specific privacy notice and therefore to have been informed about the methods of data processing and their right to request information regarding the processing, including the right to rectify, update and delete such data. Please note that your choice is voluntary, but failure to provide consent for processing prevents us from providing our services.

The undersigned declares to have understood that the information form constitutes an exchange of information and that signing it entails contractual obligations contained in the individual clauses (each identifiable through numbering and a specific title within the information form). The undersigned also declares to have understood the rules contained in the regulations and to have provided the requested information truthfully, accurately and correctly, without concealing elements that may affect their safety. The undersigned further declares to have provided the Diving Center, for the purpose of safeguarding their own safety, with the additional information reported in the notes. The undersigned is aware that, due to the occasional nature of the relationship, the Diving Center only possesses the information of which it has been made aware and which is included in the notes to this document and therefore, if any other useful information for the protection of their own safety is withheld or omitted, such information cannot be used. In this context, the undersigned assumes full responsibility for any consequence resulting from failure to understand or from false or incorrect completion of this information sheet. Therefore, the undersigned declares to have understood all obligations contained in this document and in particular those referred to in points: 5) Briefing, 8) Directives and obligations, 10) Equipment and the information referred to in points: 1) Dive with Diving Center guide, 2) Termination, 3) Exclusion, 4) Use of the diving facility, 6) Information Notice; and to have provided the information referred to in point 7 (personal and medical information) truthfully, accurately and correctly, without concealing elements that may affect their own safety and health.

The undersigned further declares to have provided the Diving Center, for the purpose of safeguarding their own safety, with the additional useful information reported in the notes.
