This agreement/information notice requires you to comply with the Diving Center rules and also contains further obligations and information of a general and specific nature.

This agreement/information notice remains valid until 31-12-2026

1. Organization and management of activities 

A) When you take part in activities organized by PROFONDO E BLU D.C. (hereinafter also referred to as the “Diving Center”), such activities are carried out with the assistance and under the supervision of a professional/dive guide from the Diving Center staff.
B) When you take part in water activities organized by third parties who make use of the Diving Center’s assistance, such activities are carried out independently, namely without any supervision/control/organization in the water by the professionals of the PROFONDO E BLU D.C. staff. The Diving Center limits itself to organizing and managing activities on the boat, entry into and exit from the water, and shore support.

2. Termination

The undersigned declares that he/she has read the Diving Center rules and has understood each individual provision, and undertakes to comply with them in full awareness that failure to comply with the provisions set out therein shall result in termination of the contract for participation in the guided dive entered into with the Diving Center. He/she also declares that he/she is aware that failure to comply with the instructions received from the Captain of the boat/craft and/or from the dive guide before and during the dive constitutes grounds for termination of the contract.

3. Exclusion

The undersigned declares that he/she is aware that failure to comply with the rules set out in the regulations and with the instructions received from the guide during the briefing, in addition to resulting in termination of the contract, may constitute grounds for exclusion from all activities, both those currently in progress and future activities that the Diving Center may carry out in the course of its business.

4. Use of the Diving Center premises and boats

The undersigned declares that he/she has understood all the necessary information and the conduct to be observed in order to properly use the services offered and the premises/areas (common areas, changing rooms, toilets, access passage to the boat) of the Diving Center, as well as its boats.

• 4.1 Personal belongings
  All personal belongings and clothing may be stored in the designated spaces indicated by PROFONDO E BLU staff. For the safekeeping of items with a total value exceeding € 100,00, the user is required to contact the management, who will arrange to keep them in custody.

5. Briefing

The undersigned undertakes to attend, carefully and before each dive, the pre-dive information briefing to be held by the Diving Center staff, in full awareness that the information he/she will receive during the briefing concerns: safety; routes to be followed; proper conduct to be observed during the pre-dive phase (both from shore and on the craft), during dives at sea, and during the exit from the water and reboarding of the inflatable boat; dive signals; mandatory communication to the guide of one’s air consumption; and the rules necessary for a safe ascent.

6. Information Notice

The undersigned receives the following information from the Diving Center: “Scuba dives with the guide will be carried out following the routes and depths described during the briefing. The maximum depth reached will be within the limits of the certification held. In the case of a mixed group holding certifications with different depth limits, all participants in the dive shall comply with the limit of the certification which, among all certifications (by level or agency), provides for the shallower depth. The dive will last for a duration that allows the participating divers to remain within no-decompression limits. The participants will be accompanied throughout the entire dive by a qualified dive guide (or instructor) made available by the Diving Center. If carried out in full compliance with the guide’s instructions, indications and directives, the activity does not involve risks other than those typical of scuba diving activity learned during the course attended to obtain the diving certification; however, since this is in any case a sporting activity carried out at an ambient pressure different from the surface, any resulting conditions and/or trauma may require treatments such as the administration of oxygen and the use of a hyperbaric chamber. To this end, the Diving Center invites you to pay close attention to the safety warnings and to the effects that pressure may have on the human body, as set out in your course manual and in the Diving Center rules.

7. Personal and medical information

The undersigned acknowledges that the information indicated below from letters “A” to “H” represents an exchange of information between the parties and therefore declares that he/she is aware of the need to read and understand it carefully. The diver also declares that he/she has been informed by the Diving Center that: “if any of the psycho-physical conditions, infections, pathologies, illnesses, procedures, situations and/or states described and indicated in letters A to H should occur, diving is dangerous to health and, in the most serious cases, even fatal. In the aforementioned cases, diving is strongly discouraged unless preceded by specific medical advice. False, reticent or inaccurate information, as well as the omission of the requested information regarding one’s medical history and psycho-physical condition, could expose the diver to serious health risks”. The diver preparing to carry out the guided dive:

• A. Is in good physical and mental condition; can swim independently and is comfortable in deep water;
• B. Is not currently suffering from a cold, congestion or ear infections and is therefore able to perform the equalization maneuver without impediment.
• C. Has not, even in the past, had problems with: asthma, emphysema, tuberculosis, respiratory diseases or any other form of lung or bronchial infection and/or illness; ear diseases or surgery; infections or other types of problems affecting the frontal sinuses; cardiac or cardiopulmonary conditions, patent foramen ovale
  or any other heart disease and/or pathology.
• D. Has not consumed food before the dive that would make entering the water inadvisable and has not taken alcoholic or intoxicating, pharmaceutical or psychotropic substances, or any medicines in general.
• E. Has not undergone surgery on the heart, lungs, back or spine, and in any case has not undergone any type of surgery during the last year.
• F. Is not in any of the following pathological conditions and/or states: diabetes; pregnancy; regular intake of medicines; smoking; high cholesterol levels; back diseases or pain or hernias;
• G. Does not have a family or personal medical history including heart attacks or myocardial infarctions, heart disease or hypertension, hemorrhages or blood clotting disorders.
• H. Does not suffer from behavioral disorders, claustrophobia, agoraphobia, epilepsy, anxiety and panic attacks, loss of consciousness or fainting, or nervous system disorders. The undersigned also undertakes to provide all personal information relating to his/her personal health and medical condition truthfully, notifying the Diving Center of any information (relating to points A to H) that may be useful to ensure the protection of his/her psycho-physical condition. The Diving Center invites you to report in the notes any information concerning you that you consider may be useful to ensure your safety and personal protection

8. Directives and obligations

The undersigned undertakes to strictly comply with the Diving Center rules and with all indications, instructions and directives received from the dive guide during the activity.
He/she also undertakes to comply with the route, depth, dive time and safety stop indicated during the briefing, without separating from the group and while maintaining the buddy system.
The undersigned acknowledges the right of the dive guide to modify or interrupt the dive at any time for safety reasons, in the event of improper conduct or situations that could endanger the participants.
He/she hereby waives any claim for reimbursement of the price paid.

9. Mandatory communications

He/she undertakes to promptly inform the guide of his/her air consumption, in particular upon reaching the remaining pressure of 100 bar indicated by the pressure gauge, as well as of any situation of discomfort before, during and after the dive (anxiety, excessive stress, cold, fatigue).

10. Equipment

Rented equipment must be treated with due care and returned in the condition in which it was received. Personal equipment must be in perfect working order and suitable for the intended purpose. The diver is required to ensure the perfect working condition of his/her own equipment. The diver declares that he/she knows how to use it for himself/herself and without causing harm to others.

PRIVACY NOTICE

He/she authorizes the Diving Center to process personal data, including those considered special categories of data, for the purposes of membership/registration/booking of the services provided by the Diving Center, as well as for administrative and accounting purposes. To this end, he/she declares that he/she has read the Diving Center rules and the specific information notice and therefore has been informed about the methods of data processing and his/her right to request information on the processing, including with reference to the right to rectification, updating and erasure of the data. We inform you that your choice is voluntary, but failure to consent to processing prevents us from providing our services.

The undersigned declares that he/she has understood that the information form represents an exchange of information and that signing it entails contractual obligations contained in the individual clauses (each identifiable by numbering and specific title within the information form). He/she further declares that he/she has understood the rules contained in the regulations and that he/she has provided the information requested from him/her truthfully, accurately and correctly, without concealing elements that may affect his/her safety. He/she also declares that he/she has provided the Diving Center, in order to protect his/her own safety, with the further information set out in the notes. He/she is aware that, due to the occasional nature of the relationship, the Diving Center possesses only the information of which it has been made aware and which has been entered in the notes to this document and that therefore, if withheld or omitted, any other information useful for protecting his/her safety cannot be used. In this context, the undersigned assumes full responsibility for any consequence that may arise from failure to understand or from false or incorrect completion of this information sheet. Therefore, the undersigned declares that he/she has understood all the obligations contained in this document and in particular those referred to in points: 5) Briefing, 8) Directives and obligations, 10) Equipment and the information referred to in points: 1) Dive with the Diving Center guide, 2) Termination, 3) Exclusion, 4) Use of the Diving Center facility, 6) Information Notice; and that he/she has provided the information referred to in point 7 (personal and medical information) truthfully, accurately and correctly, without concealing elements that may affect his/her safety and health.

He/she further declares that he/she has provided the Diving Center, in order to protect his/her own safety, with the additional useful information by entering it in the note.
